Terms of Service

1. Acceptance of Terms

By accessing or using the Pama Technologies Ltd. website ("Site") or any products, software, or services provided by Pama Technologies Ltd. ("Pama", "we", "our", or "us") — including Pamastore, PamaPOS, Track by Pama, and Ikrea — you agree to be bound by these Terms of Service ("Terms").

If you do not agree to these Terms in their entirety, you must immediately discontinue use of the Site and all PAMA services. These Terms constitute a legally binding agreement between you and Pama Technologies Ltd.

2. Description of Services

Pama Technologies Ltd. develops and operates a suite of software products:

  • Pamastore: a digital multi-vendor marketplace for campus communities.
  • PamaPOS: an offline-first Point of Sale and retail management system.
  • Track by Pama: a habit tracking and personal productivity platform.
  • Ikrea: a purpose-driven social networking platform with an AI context layer.

Product availability may vary by region. Pama reserves the right to modify, suspend, or discontinue any product or feature at any time, with notice where reasonably practicable.

3. Use of the Website

Permitted Use

You may use the Site to:

  • Learn about Pama Technologies Ltd. and its products
  • Submit general inquiries through the contact form
  • Access linked product platforms in accordance with their individual terms

Prohibited Use

You may not:

  • Scrape, crawl, or data-mine the Site without written permission
  • Attempt to gain unauthorised access to any server, system, or account
  • Distribute malware, viruses, or malicious code via the Site
  • Impersonate Pama Technologies Ltd. or any employee or affiliate
  • Use the Site for any unlawful purpose or in violation of any applicable law
  • Reverse-engineer, decompile, or disassemble any part of our software
  • Engage in any activity that degrades the performance or availability of the Site

4. Intellectual Property

All content on this Site — including but not limited to the Pama Technologies Ltd. name, logos, product names, text, graphics, illustrations, design, source code, and compiled software — is the exclusive property of Pama Technologies Ltd. and is protected under applicable copyright, trademark, and intellectual property laws.

No content may be reproduced, distributed, modified, adapted, publicly displayed, or transmitted in any form without our prior written consent. Any unauthorised use may result in legal action.

The open-source components used in our products retain their respective licences and are acknowledged in each product's repository.

5. Account Responsibilities

If you register an account on any PAMA platform, you agree to:

  • Provide accurate, current, and complete information during registration
  • Keep your login credentials confidential and not share them with others
  • Notify us immediately at support@pama.page of any suspected unauthorized access
  • Accept responsibility for all activity that occurs under your account

Vendor Accounts (Pamastore)

Sellers on Pamastore must accurately represent their products, comply with campus community rules, and refrain from listing counterfeit, illegal, or prohibited items. Pama reserves the right to remove listings and suspend accounts that violate these obligations.

Retail Accounts (PamaPOS)

Retail owners using PamaPOS are responsible for the accuracy of their inventory and sales data, for compliance with local tax regulations, and for the proper handling of customer payment information.

6. User-Submitted Content

When you submit content to any PAMA platform — including contact form messages, product listings, posts, or reviews — you grant Pama Technologies Ltd. a non-exclusive, worldwide, royalty-free licence to use, store, process, and display that content solely for the purpose of providing and improving our services.

You represent and warrant that:

  • You own or control all rights in the content you submit
  • The content does not infringe any third-party intellectual property rights
  • The content is not defamatory, obscene, fraudulent, or otherwise unlawful

7. Acceptable Use Policy

Pamastore

The following items may not be listed or sold:

  • Counterfeit or stolen goods
  • Illegal drugs, controlled substances, or drug paraphernalia
  • Weapons, explosives, or dangerous materials
  • Explicit or adult content
  • Pirated software, media, or academic materials
  • Any item prohibited by applicable law

Ikrea Community Guidelines

  • Treat all community members with respect and dignity
  • Do not post hate speech, harassment, or threatening content
  • Do not engage in coordinated inauthentic behaviour or spam
  • Do not share personally identifiable information of others without consent
  • Engage authentically — no fake profiles or impersonation

Violations of this Acceptable Use Policy may result in immediate account suspension or permanent ban without notice.

8. Disclaimers of Warranties

THE SITE AND ALL PAMA PRODUCTS AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Pama Technologies Ltd. does not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant the accuracy, completeness, or reliability of any content on the Site.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PAMA TECHNOLOGIES LTD., ITS DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES — INCLUDING LOSS OF PROFITS, DATA, BUSINESS GOODWILL, OR REVENUE — ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF, OR INABILITY TO USE, THE SITE OR ANY PAMA PRODUCT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

PamaPOS Disclaimer: Pama Technologies Ltd. is not liable for any data loss resulting from device failure, power outage, or improper use of the offline sync functionality. Merchants are advised to maintain independent backups.

Our aggregate liability to you for any claims arising under these Terms shall not exceed the greater of (a) the total fees you paid to Pama in the twelve (12) months preceding the claim or (b) USD 100.

10. Indemnification

You agree to indemnify, defend, and hold harmless Pama Technologies Ltd. and its affiliates, directors, officers, employees, and agents from and against any claims, liabilities, damages, judgements, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to: (a) your use of or access to the Site or PAMA products; (b) your violation of these Terms; (c) your violation of any applicable law or the rights of any third party; or (d) any content you submit to any PAMA platform.

11. Third-Party Services

The Site and PAMA products may contain links to or integrations with third-party websites, payment processors, or services. These are provided for your convenience only. Pama Technologies Ltd. is not responsible for the content, policies, or practices of any third-party service. Your interactions with third parties are governed by their own terms and privacy policies.

12. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria, without regard to its conflict-of-law principles.

Any dispute arising out of or in connection with these Terms shall first be subject to good-faith negotiation. If unresolved within 30 days, the dispute shall be submitted to binding arbitration in Lagos, Nigeria, under the Arbitration and Mediation Act 2023. The arbitration shall be conducted in English. The arbitrator's decision shall be final and enforceable in any court of competent jurisdiction.

Nothing in this clause prevents either party from seeking urgent injunctive or other equitable relief from a court of competent jurisdiction.

13. Modifications to Terms

Pama Technologies Ltd. reserves the right to modify these Terms at any time. When we make material changes, we will update the "Last Updated" date above and, where applicable, notify registered users by email.

Your continued use of the Site or any PAMA product after the revised Terms are posted constitutes your acceptance of the updated Terms.

14. Termination

Pama Technologies Ltd. reserves the right to suspend or permanently terminate your access to any PAMA platform, with or without notice, if:

  • You breach any provision of these Terms or the Acceptable Use Policy
  • Your conduct is determined to be harmful to other users, Pama, or third parties
  • Required by law, regulation, or court order

Upon termination, your right to use all PAMA services immediately ceases. Clauses that by their nature should survive termination — including Intellectual Property, Limitation of Liability, Indemnification, and Governing Law — shall survive.
